I recently sold a car for $1200 back in august. Today I get a call from the guys dad saying the engine is locked up, that someone left a bolt out of the starter. Now, when I got the car I put a used tranny in it and drove the car for over a year. Now he is wanting some money back for the eng. problem.
The problem is that the guy knows where I live and work, I told them it was an as-is deal and that I couldnt do anything. I could be nice and help him with some of the $$, he was originally wanting $500.
I just dont want the guy coming after me or doing anything to my house or wife. Someone else told me that if I did give him $ back then I would be admitting fault with the car. Could I have him sign a statment that if I do give him any $ back that it is for "generocity" or just give it to him and move on?

Normally, I would say let the guy handle it himself. However, seeing as he must be close by and if you are worried about your property or family, then $500 spared dollars wouldn't hurt.
I would have him sign something, though. Not a slip of "generosity," but something stating that you both agree that you admit no fault and are making a donation out of good will.
if you have a bill of sale, it protects you in this exact situation.
i had the same thing, sold my 1g DSM which was running great at the time (which is not common for a 1g), guy test drove it, loved it and was impressed. Car was Non-Op so i told him he should seriously trailer it back home (a 2hr drive for him) but ne neglected to do so. Not my problem. Halfway home the car fell on its face and lost all power. he tried coming back after me with his $3500 repair bill from his "family" mechanic (yeah, meaning 1) the guy is ripping me off, and 2) he doesnt know jack shit about DSM's). I told him to **** off finally a few months ago and havent heard a peep since. Bill of Sale and Release of Liability, coupled with the fact the car was non-op, severly puts a hurt in his case. Everyone i talked to in legal circles said the case would be laughed out of small claims once he tells them he signed a BoS.
please tell me you have a bill of sale or title transfer forms to prove the car is no longer yours?
btw an engine doesnt lock up because you forgot a starter bolt.........maybe the starter is out of alignment but that wont cause an engine failure. Nice try wannabe mechanic trying to screw over people.

I may offer to buy the car back for $900 b/c I can get it sold tomorrow for $600 and walk clear of this crap. I swear I will never sell another car like that again.
Shit happens when you buy used, especially for $1200 bucks, I paid 1k for my cherokee, knowing the motor could die the first day. if it does I'll throw a 350 in it and roll with it.

Starter bolt won't do anything..if anything I would say it would get out of alignment and possibly chip a few teeth off the flywheel? But I seriously doubt that even..unless the starter was duct taped to the side of the motor with only one bolt in.
I say you tell them that it was not your doing..and they bought the car as-is. If you purposely hid something from them..then thats another story..but a starter bolt has nothing to do with the engine failure.
Looks like a consensus. He bought a $1200 car. Everybody knows what that means. You want factory reliability with warranty coverage? Go throw down the $30k it takes to put you in that ballgame.

He does need to be informed of what as is means, and if he already knew you were driving it around for a year with no problems then that's his fault, he knew what's been put in to it. i was going to do this as well with my sale, until i lost my job. I almost did want the car back to fix it (since i knew it was likely a bullshit fix) and sell it to someone who wanted a good dsm to tinker with.

I had a guy pull a similar deal, told him to bring me the car and I'd give him his money[$400, he still owed me $100 more]. He protested and wanted me to knock off some on the car. Well I bought it back today. I had a tow truck ready when the guy got there. After the tow truck driver left with it I realized that they guy signed the title in the wrong place. He wanted the money right then even though the title was ****ed up. So, we went to the DMV to get some forms for him to re-sign and I made him sign a receipt for the cash that he got.
The good thing is I have already sold the car and made $200. I swear I will never sell another car to an asshole again.
