I work two 16 hour shifts a week on my department. It can get rough..

At the end of the day this is a tragedy from any standpoint. The mind can do some funny things to you when exhausted and being at a level 10 level of constant alertness for 16 hours after having slept for only 4 hours the night before. I've had partners crash their personal vehicles on the drive home after a few days of hard work and very long hours mixed with sleep deprivation.

I'm glad they never shot their neighbor.

I can't imagine what the parties involved are going through.
Being up for 16 hours under stress can make your mind do some weird stuff. I'm not excusing the shooting, but I've been there with sleep deprivation, and I couldn't think straight.

Yeah, cause potentially crashing into someone would be better. Right?

Stupid post.

I didn't expect much cognitive thought in his response.. It is what it is.

It's one of those: "You never know, till "YOU KNOW"." sort of things.

Interesting.

Did the DA go for a grand jury with a murder charge knowing it is a really good possibility that she won't get convicted of murder since it was most likely manslaughter?

Hmm.

She said under oath when asked that yes I intended to kill him when I shot him. Pretty self explanatory to me.

defense attorney used the stance that multiple residences get confused because it's such a big complex and everything looks the same that mistaken apartments happen all the time.

Did I miss where it is explained how she got in his place to begin with?

Was his door unlocked and she just walked in?

Great she was convicted, but since there was no premeditation I really don't see how it was murder...was 100% certain it was going to be a manslaughter conviction.

I believe their using her status as a LEO and the fact that she ignored numerous signs that she was in the wrong apartment against her.

She supposedly parked on the wrong floor. At the time she was texting her partner explicit messages as she was in a sexual relationship with him so she was apparently distracted.

Fact of the matter is she killed him and admitted she intended to when pulling her weapon. I work in Construction Management and have worked many 12+ hour days. Even an 8hr day and drove 4.5hrs home. I live in a Condo development. If I used that excuse and walked into the wrong unit after a long day and killed my neighbor, you can bet my ass would be in prison as well.

"When questioned by the prosecution Guyger admitted that she stopped lifesaving aid on Jean twice to send text messages to her partner and former lover Sgt. Martin Rivera.

And when prosecutor Jason Hermus asked the former officer, “When you shot at Mr. Jean you knew you were using deadly force against him?” she replied “yes”. When asked if she intended to kill Jean when she shot twice she also said “yes”."
