Strange noise from convertible top motor?

Hi, I’ve been having this issue for a while now, at times while driving there is this whining noise (not the supercharger of course) that comes from what I think is the convertible top motor, the noise goes away if I put the e brake on and then hit the convertible button to raise/lower the top. It’s also strange and worth mentioning that sometimes the noise will match the revs strangely enough, but I’ve gotten good enough at fooling the top into thinking the e brake is on and hitting the button and the noise goes away immediately. Anyone know what could be causong this?
My car is a 2004 Mystichrome Cobra Convertible with 54k miles

You'll notice some oil directly between your rear tire/door underneath the car. It's such an odd spot to have an oil leak but it's actually the hydraulic fluid from the convertible cylinders leaking. You'll notice it when you put your top up/down.
