Yea, you do have the right, and you'll go to court, where you prove you weren't drunk. Thinking you guys have "freedom" in this case is kinda a joke, both of us have the same outcomes. And we have freedom from smog testing, that's more important, I dgaf what they do to drunk drivers :D

No inspections here in SC, plus the burden of proof in a criminal case is on the state here. One last thing..... gas is $1.35USD/gallon right now (~0.50CAD/L). :D

Any interaction can be used as evidence. Slurred speech, glassy eyes, alcohol on the breath, etc. Plus, they will get a subpoena for a blood draw once you get to jail and most larger municipalities will have a trained phlebotomist on staff at all times.



Typical 1st time DUI defense without complications (no wreck, property damage, injury, kids in the car, etc) runs around $10,000.



No right against self incrimination in the British Colonies?

All subjective. Best friend is an oui attorney only. He beats them consistently when there’s no physical proof. With no prior interaction between the officer and defendant there’s no frame of reference. It’s not illegal to have a few beers and drive. It’s illegal to be over the limit of .08. It’s not possible to determine if someone is impaired based on the smell of their breath.
