Disorderly conduct 2nd degree.... fml

My roommate had a party celebrating his birthday, they rented a small bar and everything was going great... when...

someone announced that we would continue the party at our apartment, which was not really the plan..

We get home, and eventually 30 people or so roll in and everything was containable so no one made a big deal about it. Then two guys got in a fight.

I come out of my room, and grabbed one guy up and was like man I told you not to be fighting tonight in here and pushed him outside, He swung at me, and we ended up in a fight, his buddy jumped on my back, I finally got him off me and was on top of dude number 2 when I got sucker punched in the back of the head a few times... Well luckily I didn't get knocked out and jumped up trying to figure out what was going on when about that time the cops rolled in .

They give me and my roommate both a ticket with one charge being Disorderly conduct, 2nd degree. In the comments, they basically states that our third roommate (who was not present) threw the party and we were trying to end the party.


Two of the cops were pretty cool about it, but you could tell that the third felt like someone needed a citation so I suppose we took the blame.


I've had a few traffic violation citations before, nothing major. What will probably happen in result of this? whats the 2nd degree about?

haha...

honestly I am not the fighting type at all... we just have too much stuff in our apartment to get broke for that kind of thing to go on in here...

I was charged with disorderly conduct and ressisting arrest w/o violence about 17 years ago in FL.

The fight was already in progress when the cops rolled up so they could not figure out who started it.

You might not believe me but it was actually self defense.

You have every right to defend yourself if you feel you are in danger.

Pled not guilty and took it to trial. My attorney asked the police officer if he witnessed how/when the fight began. The answer was no. Then we had like 5 or 6 witnesses testify as to how the fight started and in the end I was found not guilty.

I hate to tell you this but that citation is a criminal citation which is tantamount an arrest. The 2nd degree means you were charged with a 2nd Degree Misdemeanor. Time to call a criminal defense attorney.

here is what the 2nd degree means, or rather why you got it. Most criminal offenses will have a degree assigned to them based on severity and other factors.

assuming they don't give you jail time(which i can't see happening) I'd recommend getting an attorney and working out a diversion

yeah I'd get it diverted or try to get it dismissed. Likely just a fine in KY, or that's at least how they do it in jefferson co. not likely to get any jail time.
