I plan on fighting a ticket, and have a copy of the officer's report; my question is... how much does having a passenger (witness) affect the whole "my word against the officer's" (and no, that's the the basis of my defense)??? Thanks,

Logan

It all depends on circumstances. What was the ticket for? How is your driving record? How was your attitude with the officer? What are you claiming? Do you have any documents/photos to prove your case?

If your witness is going to be reliable and honest and can present a good case then bring him. But remember once your witness testifies then he is open to cross. So, the prosecution then can ask him questions that might DQ him.

Good Luck

WORD!

Judges hate it when people bring in a person that is nothing more than an echo of the first person. If they have something factual to present, go for it. But if they're just going to sit there and say... "No Your Honor, he would never do that. The cop is lying". The judge is going to get real annoyed, real fast.
