Serious question. If you are Texas law enforcement, why are you not aware of the law? You should know that no one has a right to physically attack someone else. Those actions have consequences. Minimum consequence is getting in a fight and going to jail. Max consequence is referenced here.

As you pointed out, we are not in the 5th grade, but we should all know to keep our hands to ourselves.

Lots of wrong occured here. If the shooter instigated the confrontation, he was in the wrong but he still did not make it physical. His right to defense started when it became physical.

Any of the 3 people involved could have deescelated this.


Dead guy is a criminal according to records posted above. Shooter could have known of the dangerous criminal attacking him as well.

Last guy that assaulted me got 18 months. Just me and him out in the brush. He was handled by the time back up got there.

Edit - BTW, my post you quoted wasn’t a dig at LEO or you. I was making the point that as a non-LEO in that situation, it can quickly go from 1 on 1 to 20 on 1. And help will likely be a long time coming, if ever, before help arrives.

You do. Why I said blast away. If I walked right up when the push happened, I'm confident I would have shot the shooter before he could've dropped his gun.

Oh, and the 145lb women I work with wouldn't even shoot in that situation. Training and confidence. Can't buy that at the gun store.

Think about that for a min and either stop carrying or get some training.

I’m on the fence on whether the shooting was justified. I will say however, this is what happens when people stop being decent, and following the rules and or doing whatever they want when they want. These people who park in handicap parking spaces knowing that they shouldn’t, parking in fire lanes, or thinking that the rules don’t apply to them. If they would’ve parked in a regular spot he would still be alive.

All good man. No issue with people carrying. But a more appropriate response would have been to stay in the supine (on your back) position and hold him at gun point. Very vulnerable position but less so than trying to get up with him so close. Good shooting position though and if the guy had moved to continue the assault, then I would be on board with the shoot.

I don't see how this was justified in the least bit. As a CCW holder, once the situation de-escalates, call L.E. I can't say I know what I would do in that situation, but I would hope I would do what I think I would do, which is Not shoot the guy after he backed off.

Again, in my opinion, this dude looks like he's been wanting a reason to shoot someone. He isn't the parking police and judging by his history, he loves confrontation.

I’m a strong proponent of LEO and have been carrying for 20+ years. Fortunately, I’ve never had to draw my weapon on anyone in that time (those other instances were as a much younger and more naive me). It’s the slight pause from the time the gun was drawn until the trigger was pulled that bothers me. I feel like the shooter had time to recognize the change in the threat. But then again, the shooter may have been knocked silly by the shove/landing and was just then able to acquire his sights.

I could easily argue both sides. Which is why I don’t put myself in those situations. Even if you win, you lose.

this is absolute ****ing bullshit. The "pusher" had no weapon visible. You can't just ****ing shoot somebody because they push you to the ground. If the "pusher" had pulled out a knife or a gun, then sure, blow his damn brains out. But c'mon, this is a pussy fight. It's not like the offender was beating him with a bat. His life was NOT in danger. Stupid ass law is coming into play here. ****ing ridiculous ...

part of the responsibility of carrying, is to quickly recognize a deadly threat. IE is the other person standing in front of carrying a deadly weapon. Is your life in eminent danger?? At that point IF YOU ARE NOT SURE, you shoot to DISABLE and not to KILL . Shoot them below the waste line to disable them. After all, you don't want a lawsuit. In this situation, he CLEARLY has no weapon. IMO this is murder.
