JC France Case in Florida

Maybe one of the LEO's can explain the reason JC France's arrest was thrown out for DUI and Cocaine possession in Daytona Beach:

If I understood this case France (son of NASCAR chairman Jim France and nephew of Brian France, head of NASCAR) and his half-brother were racing their Porsche and Lambo drunk, got pulled over, and arrested for DUI and Coke possession.

Somehow now the charges are dropped for "out of jurisdiction" because the cops chased them from one town to another and then made the arrest.

Does this mean that if you, as a LEO are chasing someone and they go into a neighboring town you're not allowed to arrest them?

Or is this another "got money.......walk free" cases.

There was a defense motion to suppress evidence obtained during the traffic stop as the defense claimed the traffic stop was unlawful and therefore any evidence obtained was fruit of the poisonous tree and not admissible.

The stop was illegal because the officer who arrested France was out of his jurisdiction and there is case law from the 5th DCA that says the officer can effectuate the stop but must call an officer from the actual jurisdiction to make the arrest and the subsequent "search incident to arrest" where the drugs were found.

This type of thing happens quite often and is not unusual. It has nothing to do with the defendant having money.

If a LEO chases someone into another jurisdiction in Florida they must request assistance from the L.E. Agency who has jurisdiction in order to arrest the suspect, but the officer can still make the stop.
