Off-road H-pipe and NY inspection

I would like to install a o/r hpipe but I live in ny and I have to worry about inspection through the obd2 port. I'm not worried about the visual part. My question is that is it possible to install the o/r pipe without getting a tune. I want the pipe for sound and I would like to remain stock otherwise. I had an offroad H on mine with no tune. no CEL. I had only driven it about 250 miles like that. I can't comment on long term. I used no anti fowlers. everything was installed like stock.

My cats have been gone for 5K miles that included 6 open track events. I have the factory tune with similar o2 eliminators that move the rear o2 out of the exhaust stream.
