Quick Texas Title Question I need help ASAP.

I am going to look at a 01 Trans AM M6 car today, and he is saying its been dated, and he may have signed it, he doesn't act like he knows what he is talking about. It is still in the previous owners name. I am pretty sure I am going to need a affadavid, but who if so who has to sign it, this guy or the previous owner? I know as long as the owner didn't date it, and this guy didn't sign it, it will be ok, but it really could run into a title nightmare. TIA
