I was listed as a co-defendant by the other parties, because I had a $3,000,000 policy, not because I caused the accident. Because the vehicle I was driving had such a large liability coverage, the person's insurance company that caused the accident refused to pay for any damages to any of the other parties involved. It took multiple lawsuits by me and the other parties involved to bring the offending party's insurance company to agree to compensate for damages. What aggravated me the most is the fact is the commercial truck insurance liability company agreed to participate in the claim payout by 50%. When I asked the lawyers why this was happening they stated at this payout it was cheaper for their client(my insurance company) to pay 50% of the other parties claims then to go to court to have the responsible party's insurance company pay 100% of the claims. The legal battle over this accident took the course of 3 years to resolve, with none of the innocent parties involved in the accident receiving a single payment for compensation for their cars, trucks or medical expenses. Everyone involved had to use their own insurance company's collision coverage to pay for the damage to their cars and then let the insurance companies fight for who was going to pay 3 years later. The insurance company of the responsible party that caused the whole accident knew up front that that the insurance company of the large commercial vehicle had much more to lose and forced them to payout regardless of fault. This is what our sue happy lawyers have done to what 50 years ago used to be a fair system of insurance coverage for everyone.

The insurance company isn't worried about you or your car, they're only worried about how little the payout will be and they will fight you every step of the way to reduce that payout by as much as possible.

Most of the time on the property loss the insurance companies will negotiate a fair settlement without lawyers involved, but as soon as there are physical injuries the only way you'll get a settlement on those is with a lawyer in today's society in sue happy America.

OP......I'm glad you feel physically fit.
Dealing with insurance companies with a loss is not an easy thing to do. You as the claimant have to realize it is the job of the insurance company to not cover your loss in the most equitable fashion, but to have you settle the claim for the least amount of money. They aren't covering your loss. They are only watching out for themselves and their shareholders profit margin for the year. Unfortunately I've been involved in an accident where I was listed in the lawsuit, even though I didn't cause the accident. The reason I was listed as a co-defendant in the lawsuit, along with the person that caused the accident was the fact I was in a commercial vehicle with a $3,000,000 liability policy. But do yourself a favor, try to get an MRI of you spinal column to determine whether you've had a spinal disc injury. That was a hard hit. You maybe be fit as a fiddle, but you can also have an underlying injury that may take a while to feel its effects also. Sorry to see the car in that condition.
