Whipple's are CARB legal given you are running either a 3.5" or 3.25" pulley (if the tech even checks, or if they even care its a whipple, or they even realize its aftermarket) +1 on reverting to stock midpipe. Mine epic failed with the Bassani Catted X, same results as OP a few years back when i tried to sell the car with the Catted X. Blows roses with the stock midpipe. I just passed earlier today, had to get it smogged so i can sell it. Wasnt worried at all with the stock midpipe, it passed awesomely, everything was under the average results, mods in sig and all i put back on was the stock airbox to pass underhood visual. What happens is one set of cats scrubbs Co2, and the other scrubbs NOx, without two sets of two cats, one set gets overrun with either-or, usually fails NOx. Its nothing to do with the tune, and everything to do with the midpipe, throw the stocker on and go back.
