Need Advice... Am I Scrwed?!

Here's the background info...

Alright, several months back before I swapped the 04 Cobra motor into my stang, I had a 2V GT motor in it.

The motor was in perfect working order, it was full bolt on including Stg. 3 Patriot ported heads, cams... In preparatoin for the 4V Cobra swap, everything was parted out down to the 2V block which had about 27k miles on it.

The 2V stock block and bottom end (pristine conditoin) complete with harnesses, and engine accessories, was sold for $850.00 + shipping.

Normally, I wouldn't give out any personal information but I think at this point after no cooperation it is more than necessary.

The buyer, Alex Duron, set up all the shipping plans and arranged to have the motor picked up at my house. I told him I can eaisly strap the motor to a crate which I did and even had a few friends over to help load it into the truck for the driver.

The freight company is Conway Freight. The bill for shipment was about $520.00

The buyer was was very professional thorughout the transaction, even spoke with him on the phone once.

HERES WHERE IT STARTS.

Mr. Duron, apparently, somehow made the invoice (that I signed thinking he had taken care of everything) appear to say that the freight cost would be billed to sender. (ME).

So a week later I get the $500+ bill in the mail, I email him immediately to which he responds: "Yeah, i'll take care of it just send it to my address". So I did... And No responce, so I email him again because I get ANOTHER bill in the mail now with a late fee, and ask him if I can fax this bill to him and he immediately responds saying "Yeaht the fax number is 921-8143"

*Quotes coming directly out of email corespondance.

Still nothing. Now i'm getting notices from Conway in the mail saying my extremely delinquent account will begin to affect my credit rating blah blah blah...

Now, Mr. Duron does not answer ANY emails, the telephone number is no longer connected apparently etc etc...

I call Conway Freight and make them aware of the situation and apparently there's nothing I can do. They said in order for them to send the bill to Mr. Duron, they would need to receive a signed fax where he agreed to pay the shipping.

I was contemplating sending part of our corespondance with his name on it, but then started thinking maybe this would be against the law.

Is there anybody that could help me handle this? Or give me advice? Point me in the right direction? What needs to be done!? Or am I just screwd.

Sorry for the lengthy post. Any input appreciated.

It sounds to me that since you signed the invoice agreeing to pay this shipping, then you are SOL. Perhaps this gentlemen was banking on you not reading all of the paperwork. Misleading for sure.

Might have to live and learn on this one.

pretty f'd up....i wouldn't have shipped it if the paperwork had said i'm responsible for payment.....

i think the guy can pretty much tell you to f yourself and theres nothing that can be done about it.....just spread the word of what a jackass this guy is and maybe he'll man up and take car of it to prevent looking like a total dick

Sending Conway correspondence with the buyer's name on it will do no good. You signed the waybill, and at that time, the shipping costs became your responsibility.

The address you shipped to is a residential address - typically Conway will not deliver in a residential neighborhood. You might be able to find out who signed the waybill when the engine was picked up and go from there.

It looks like he is married to the person that owns the property. I do have a phone number that's associated with the owner of the house, but I'm not sure if it's correct for him. His drivers license is still registered at that address so it's possible he's still there. PM me and I'll shoot you the phone#.

Might give World Metals a call and see if he actually works there. Ph - (915) 759-7515.

can a company really affect your credit rating if they dont have your social security number? for all they know, they could have the wrong name :shrug:

don't know how it is with shipping co's, but some companies sell off their delinquent accounts to collections agencies so they can do all the work in chasing you down until you pay up and leave marks on your credit report.

wow, and i thought the whole "post it on svtperformance.com and someone will track them down" thing was an exageration, LOL. that really does suck man. evidentally he was trying to predict if you would be bent over at that time...

I've tried calling every number I have on him, the house phone and cellphone numbers do not work. "Number has been disconnected or is no-longer in service".

Here's what i've done... I scanned the latest Conway Freight bill and where it said my name and address I made it show up as His name and address, and also put his business name on there. I then faxed the bill with his name on it addressed to Worlds Metal which I did find out was the Co-signee for the shipment...

So the company he works for will receive this bill and hopefully confront him about it. Under Comments I put: "Law Enforcement Obtained Information"> Suspect: Alex Duron etc. etc... LOL


I also then faxed a letter to Conway with some of our correspondance however I organized the corresondance in such a way to make it sound like he was directly claiming responsibility for the bill. This was sent to Conway Freight...

We'll see if this leads to anything... =)

im hoping that it doesn't go to court after you doctored up the shipping bills because now the outcome could be affected by the claim that your are falsifying documents. You may have just lost credibility.

It was a creative idea, but IMO it may have created more problems if this ever does get into a legal battle now.

Just cross your fingers that he doesn't call your bluff...

The thought crossed my mind as I was doing it, however at this point I figured i'd at least try SOMETHING before bending over and paying it.

Perhaps Conway will recognize the letter and put his name on the bill themselves, I did use quotes and was very professional with the letter. That's the best case scenario for me I guess.

It will never go to court, I don't have that kind of time or persistance, nor do I think it's even worth it. What kind of case would I have? I signed the bill without reading it! :nono:

Worst case scenario,which I assumed anyway, end up just paying it.


We'll see!

Im stationed at Ft. Bliss. Ten miles from me is where this address is.

Would you be willing to taking a drive up there and asking some questions? If it saves me $500.00 i'd be more than happy to give you some kind of commission and cover gas and all that. I'm sure we could work something out, let me know!
