He wasn't fired. Why would he go to a mediator? Also, both sides must agree to mediation. If the restaurant doesn't want to, no one can force them unless it's in his employment contract.

if he gets the termination call he should do what I said is what i meant. yes on mediation, both sides must agree and mediator does a damn good job. Nobody wants to get sued and Mediator straight out tells the employer, "you better get in some kind of agreement or else defending a law suit will cost you a lot and no matter if they win a dollar or 1 million dolars, you would have to cover the court costs too which is a lot less than what he/she is asking" Just like that so you want to throw some cash or give the person's job back to avoid all that pain.
