Alright, so about a month ago, my wife got in a fender bender. A 19 year old kid tapped the rear bumper of her 2012 Mustang. The kid didn't run or anything but he didn't have his insurance card on him. Apparently, he told her he had insurance and called his mom to tell her to try to find it. As to whether he really was or not, I have no idea as I wasn't there.

Well, she didn't think to ask him at least for the insurance company name.

I've got a picture of his driver's license, vehicle make/model, and license plate and was wondering if with that one of you guys could help me determine his insurance company. My insurance said they couldn't really do anything without the name of his company since the repair cost is lower than our deductible ($500 deductible, $493 repair cost).

The kid was responding to our text's about paying us with a check out of pocket so his insurance wouldn't go up but he stopped responding. Guessing his parents told him to just not do anything and the problem would just go away. But we're paying that $493 out of pocket and if I can manage to get that covered by his insurance, that would be nice.

So if any of you guys can provide me with any sort of assistance I'd appreciate it! I'm not even sure if this is possible but I figured with what I've seen on here, it's worth a shot.

Please don't lecture me on what should have been done at the scene of the accident as I was not there and my wife is not exactly a confrontational person. Lesson learned for her but if someone could provide help, I'd appreciate it!

Worst comes to worse and you do small claims court, theu would probably get scared by the notice and pay up.

Go to his residence. Tell him to cough up his insurance company/policy number or prepare to go to small claims court, his choice.

File a claim with your insurance company to get the vehicle repaired. You'll have to pay your deductible, but your insurance company will then sue the at fault party to recoup their cost along with your deductible. During that process, if there is insurance it will be discovered.

This process if called subrogation and is pretty common in cases where the party is not cooperating. It's pretty to easy to find insurance once you get a notice of suit of collection against you that can affect your driver's license, wage garnishment etc.

That's what I did first. But like I said, the repair is just less than my deductible so they don't have any reason to dig into it. Kind of confusing since they seemed to act like if I had the name of the guy's insurance company, then something could be done.

I'm not going to lose my ass over $493 but if I had another option (besides going to the guys front door like I'm going to kick his ass or something) I would prefer to try to get it covered.

My insurance did say I could send him a certified letter to try to get him to pay but ultimately there wasn't anything official I could do.

Wouldnt this have some sort of legality issue? Dont you have XX hours to provide proof of insurance? Couldnt you get the authorities involved? I couldnt imagine the thought crossing my mind that i would eat $493 (or anything really) for someone hitting me.

File a police report as hit and run. That will get the ball rolling without any financial cost to you.

<$500 in damage must be a buff and reclear kind of repair job. That isn't anything.

No, full strip and repaint. Found a hook up and was trying to pass the savings onto the kid so we wouldn't screw up his "insurance" over a minor rear-end tap.

Yeah I'm not entirely sure of that aspect. Really, my wife didn't do a great job of getting proof of the accident besides the paint damage on her car, his license plate number/vehicle, and his drivers license.

Sorta what I'm thinking as the only option. But as stated above, not sure I have enough proof and not sure if the timeline is too far out now.

Sounds like you're the one that's not exactly confrontational. I imagine you would've handled it the same way your wife did, the path of least resistance.

Call the police, ask for a police escort to his casa. Get your $493 and move on.

Haha, thanks for the call out.

But yeah that's a good idea.

That is the most sensible idea, the one by 13COBRA. You say you don't want to lose the money, but you are making a bunch of excuses as to why you haven't confronted him yet...you must be a lot nicer of a guy than me. I would already have the car fixed by now lol. He's 19, obviously not going to be much of a Billy Badass so go to the address on the license and get your money. Or I'm sure a SVTP deceptive can get you the address of his parents house if he doesn't live with them, although with him being on his parents policy, I'd bet he does live downstairs, in the basement, watching two guys go at it...

Too far?

Good luck though, should be pretty easy to get this cleared up.
