on the way to work i was doing some spirited driving and a LEO on a bike came out of no where and was behind me at the next light. he lit me up whenit turned green i pulled into arco, he claimed he got me on radar doing 55 in a 35 i didnt argue it i didnt know how fast i was going and sure didnt want to call him a liar. he cited me doing 40 in a 35 and says it on the ticket. what can i expect in court for that? havent got a speeding ticket in 5 years, which was 57 in a 40 nothing major.

You're very fortunate that he dropped the 55 in a 35 to 40 in a 35. I can't answer your question with a definitive answer, but only 5mph over doesn't seem to be much at all. He already gave you some slack so I'm not sure you want to dispute the 5mph over the limit, although if you did it seems likely that it might be dropped or you might get a very small fine with no points against your license.

ya its not worth disputing im just trying to figure out if they are going to rape my wallet for a cited 40 in 35. im in las vegas NV ive been to the court house before but not for speeding in this state.

As long as you aren't a turd about it, you can probably get a pay arrangement (either through the traffic desk at court clerk or the judge him/herself) if it ends up being a huge fine.

You should be able to look up what the range of fines are for 5 over. Take traffic school and it won't be on your record. Just be careful for the next 18 months or so and you won't have to worry about insurance premiums going up.

I would dispute every ticket you get. Costs a little more money up front for an attorney but they will usually get it reduced to a non moving violation or dismissed.

be very respectful with the prosecutor and I'm betting there is 99% chance they will toss it or allow you to make a donation to some charity as long as the "Drifting" part was left off the back of the summons he filed out u shud be good if u haven't had anything in 5 years.

OP, the only issue with going to court over it is that the officer may be able to testify to the original violation, at which point the judge could fine you more harshly than what the pre-payable amount might be. I speak with first-hand knowledge as an LEO on this, as I have done exactly what the officer did for you. People come to contest or see if they can get the judge to help them out not realizing that the judge is going to ask me for the story behind it all.

ALWAYS hire an attorney. Keeping it off your record is paramount to anything else.

I always go to court but the I have never been cut a 10mph break like the op. Frankly you are better off in this case paying the fine and moving on. Lawyer will cost you probably 3or 4 times what the fine will be. And if this is truly your first ticket in five years any point will likely drop off before your next one. Read Silvers advice very carefully and maybe three or four times before going to court
