All the police need is reasonable suspicion to stop you. That’s not a very high standard to make. They need PC to search and or arrest you.
I did not say/imply that being out late is PC for a stop. That being said, it can cause an officer to notice you and look for PC.
Running your mouth and getting smart with an officer, while not illegal, is not going to help you in any way. Court is not held on the side of the road. It can often times change a warning into a ticket. It's also just poor taste.
Not sure if that was in reference to my comment, but being out after midnight doesn't constitute reasonable suspicion, either. In fact, it doesn't constitute shit.
I'm going to have to drive home 2.5 hours from Chicago next Monday night. It will be well past midnight when I'm on the roads. Should I be pulled over if I'm just minding my own business, trying to get home, simply because I had a late arriving flight, and it's late?

Again, why would the simple fact that someone is out after midnight cause the police to behave ANY different towards them if there are no other extenuating circumstances?
Proactive officers don't sit around waiting on call outs.
Again, I said that being out late at night could get you noticed and draw attention.
During the day, you would blend in with other traffic much easier. Depending on where you live and or drive, being out after midnight could make YOU the ONLY traffic.

I am and have been employed at places with shift work. Have I been stopped late at night? Yes. Did I do anything wrong? No. Did I run my mouth at the officers? No. Did I receive any tickets? No. Was it an inconvenience? Yes. Did I file complaints? No. I understand why and what they are doing.

That being said, I have learned this: Be kind, be curteous, do EXACTLY what they say. 99% the clowns that get tickets or jailed are dickheads to the cops.
