I got a speeding ticket 22348 b vc and would really appreciate advice from either LEOs or anyone knowledgeable in the situation. I'll explain the event in as much detail as I can to give a chance for the best assessment of what I should do.

I was traveling on I-5 South in CA about 25 miles north of Valencia going at speeds approximately 90 mph. I was speeding irresponsibly and it is something I do not want to try to justify, I got carried away by the speeds of the vehicles traveling near me and shouldn't have matched their speeds. Going down the mountain I see a CHP officer (too far to tell if he was moving or not but the passengers in my car thought he was moving) on the far right side of the road and I slowed down significantly. Unfortunately for me it was too late and he put on his lights behind me.

As soon as I saw the lights I put on my signal to show that I was pulling over but I was not sure where to pull over because I did not feel there was a safe amount of room on the shoulder at the moment. I continued in the right lanes for about a mile until the shoulder no longer had a barrier and I could pull over safely. Before I was able to pull over I could see that the officer was noticeably upset and making hand motions through my mirror.

When I pulled over the officer charged towards the car yelling profanity and was very upset, asking things like if I knew who he was, or where I got my license. I tried to explain to him very politely, always addressing him as officer or sir, that I was trying to find a safe place to pull over but he didn't want to hear any of it and continued with the yelling.

He finally asked me how fast I thought I was going and I said that I was not sure because I honestly wasn't. I felt that I was going around 90 mph but I am inclined to believe a LEO if he is telling me what speed I was going. He said 101 mph but did not present any evidence that would suggest that I was in fact going that speed and I guess its possible that in his anger he would want to give me a significantly harsher penalty. The ticket shows a box checked Radar/Lidar unit/ Patrol vehicle No.

He called me out of my vehicle to explain to me that this was going to be a heavy fine and I would probably lose my license for 30 days. By this time he was much calmer and it seemed much more like he was just having a bad day. He advised me to go to court and told me that if I was going that fast again he would take me to jail and impound my vehicle. He then told me to be safe, I thanked him and went back on my way.

I am looking for advice on how to handle the situation. Through a quick google search I saw multiple responses and do not know how to sort through the bad advice and the good advice. Should I contact the officer? Get a lawyer? Fight the ticket? What should I expect? Can I get the court location changed? Is a court appearance necessary? Should I plead not guilty and explain that I didn't feel I was going 101, or plead guilty and apologize for going anywhere near that speed?

I am a 21 year old full time student and the court is 300 miles away. I understand that a possible penalty is losing my license for 30 days and this would be disastrous for me. All advice from those with valuable information is greatly appreciated, thank you.

Don't speed? When the lights come on, you must pull over immediately. If you get popped by a Chippie, your getting a ticket no matter what.

I really don't know what to tell you. You can do trial by written declaration, and give your side of the story. You can go to court and speak with a judge and he may lower your fine.

just show up early for your court date

explain the situation as you did here to the attorney at the court...they'll probably drop it to something like 10 over...if they dont, then let yours go before the judge and tell the same story

do you have tickets on your record? that will help a ton if you dont

i'm assuming you got the ticket in L.A. county? i would definitely contest that 101 mph speeding charge if you weren't going that fast. if you contest it, the court will more than likely settle for a lesser charge against you since they don't want to spend a bunch of time and money going through the whole court process...i've done it for several tickets and judges around here will usually work with you if you appear to be a decent individual.

i would also file a complaint on that CHP officer for using unprofessional conduct towards you. i'll be damned if some CHP officer yells at me and uses profanity over some stupid speeding ticket...especially if i was nothing but polite and cooperative with him...

Should he have pulled over in a place where he would have blocked a portion of a traffic lane on a downhill grade? I realize that the officer requested him to pull over but it isn't wise to just pull over anywhere.

I was once pulled over on a moderately busy expressway, I saw a side road about a quarter mile up and continued there and turned and pulled over on the side road instead. The officer didn't say anything one way or another about pulling over there but I did get off with a warning for speeding - never actually found out my speed, but it was 10 mph over or less.

Something similar happened to me:

I was on the last leg of a road trip from northern Minnesota to Milwaukee, Wisconsin (it was about 600 miles one way, and that might not seem like that much, but i was on a crotch-rocket). I was eager to get home, tired from being in traffic (there was an accident in st. Paul) and pissed off because it had been raining for the past 2-3 hours. When it cleared i was doing about 90mph (highway was quite empty and there were no signs of any LEOs on the way there), just trying to get back home.

when i was just passed Madison (1.5hrs away from home) i was going 68, i see a trooper and slow down slightly, nothing happens... about 2 minutes later (as the car behind me swerved into the "slow" lane the officer was behind me. He turned on his lights. Similar to what happened with you, i did not think that there was enough space to stop, so i slowed down to 45mph, left my right turn signal on and drive on the line at the edge of the road. I took the next exit, and when i was on the off-ramp, the LEO actually turned his siren on me. i stopped just off the ramp.

When he approached me, i apologized for taking long to stop, he asked why i did, and when i told him for safety reasons, he scoffed at me and when back to has vehicle. when he got back, he asked me how fast i was going, i told him 68 and he said that there were some calls/complaints about a motorcycle going 100 on the hwy. I got 2 tickets that day, one for "68 in a 55" and the other for "failure to yeild/stop for an emergency vehicle".

I went to the court date in Madison, and the Judge was surprisingly "cool", he really worked with everyone there (not like in Milwaukee where they had a bartering system down just to get through all of the ppl that were there, yeah, unfortunately this one was my second).

The judge increased my speeding ticket to about $250 (from $160) and dropped the $350 "failure to yield..." ticket (which meant getting only 4 of the 8 points too).

the real kicker was that on the way back i took the same road that i was pulled over on..... it is a 65 (not a 55):fm::mj: kinda unprofessional :mj:

I think that you should go to court and "fight" it, I'm my experience they are more lenient on you if you try, show up well dressed. About asking for a location change, i think that you have to do so in writing before a certain date (if it is 300 miles away, i'd consider doing it.... but if you are moving the court to a bigger/busier city, it might not be that good of an idea) if you can get a lawyer, that might not be that bad of an idea, you might not even need to show up if you do (only the lawyer does here in WI i believe) but I'd look in to that.... you will probably get several letters from firms that spam people that get tickets.

please note that all that happened to me was in WI, so things in CA probably are a bit different, but i do not think that much.

You are guilty. You can go to court and explain to the judge that you were only doing 90.

As a side note, the officer puts on his lights when and where he wants you to pull over. It is not up to you to decide where to stop. The officer was likely upset because this is a tactic used by gangs and others to ambush officers.

I would suggest finding a local attorney to handle it for you.

really? I will probably start another thread about this, as I dont want to take this too much off topic, but I have been lit up on a highway that was under construction...literally NO place to pull over, without blocking an ENTIRE lane of traffic on the highway itself (the shoulders had k-rails blocking them) I just pulled over to the far right lane, and put my hazards on, and took the next available exit, that was probably 3/4 of a mile down the road.

The officer actually thanked me for not pulling over on the highway.


guess it depends on the officer.....

I wouldn't even try to fight this one....... The court there is very harsh on these things and they deal with this violation ALL THE TIME. Especially on that part of the freeway..... Just take your lumps and move on. You could try the " I thought I was only going 90" bit, but the court will take the officer's side and you'll get hammered. I'm talking from experience here..... I used to work in that office, wrote these tickets all the time, went to court all time, and heard ALL the excuses.

lol, he lives in CA...a state about to go bankrupt...if anything this will end up costing him more if he tries to fight it and loses...this is the point where they tack on court fees and other shit like that.

my advice get a good traffic lawyer and see what he can do with it...i got a lawyer for my last ticket which was $180..paid the lawyer $60 and he got it dropped...i have no idea how but he did, and i do not have a clean driving record by any means...

Check it out bro...Not the best thing to say but ive had at least 15 tickets including two misdemeanors and i have never been charged on anything...why...this is how to get it out of this bs! Cops dont have a right to talk shit to you lol Ive took every single one to court so believe me court to me does not scare me one bit...

1. Check the online system about 2 weeks before your ticket. When you see it, it gives you possible actions...extend it!!!

2. Two weeks before your extension go back online. Theyre will be another option to either get another extension or court date...If extension is available do it again...if court date is available do that and set it!

3. No your at your court date...Show up its called an arraignment...this isnt where you tell your side of the story its whether you want to fight the ticket or not...basically your plead! Plead not guilty and contest it!!!

4. By now this court date is about a year later depending on the court!!! So now you show up at court here is what goes down:

4a. If the cop doesnt show you automatically win and in most cases they dont because he is going to remember you a year later!

4b. If he does...dont panic yet...Say you were going speed limit...never admit you were going more!!! Reason why is because he needs to present his proof...which is speed caught on radar and when the radar was calibrated last for accuracy...again a year later info is most likely not there!!!

By now you gave it your best shot and if you arent out of it then just proceed to resolve it regularly but my point is after all my tickets and bs ive gone through with the damn chp and cops...trust me lol!!!

Thank you for the advice guys, please keep it coming if you have something to contribute.

For clarification, I am not trying to get out of a speeding ticket, I am trying to get the 100+ ticket reduced to a less than 100 mph ticket. The 100+ is significantly harsher has a potential 30 day suspension along with it. I work 2 jobs and am a full time student so this would be the steepest penalty. I would not be lying since I sincerely believe I was not traveling at 101 mph. I am asking for advice because I realize it matters very little what I believe in court, and I am unsure as to what my course of action should be, and what the chances are of getting this reduced.

Well now that we know your intentions...Go in there and say you were going "90mph" and pay the nice fine...its not gonna be cheap by any means...especially not now your definitely looking at over $500...They will reduce it from 100mph bcuz your admitting you were speeding just not 100mph+...good luck!

Can you show some proof of defeating fifteen+ citations (including two misdemeanors)? Otherwise I believe (as do most of the other readers) that the smell of manure is pretty thick right about now...........:bs:

Believe me i have nothing to lie about and if you were in so cal follow those steps and see if im full of bs...and the misdeamenors the best lawyer in so cal took care of them...all the street racers use this lawyer...used to be an ex judge...so like i said you tell anyone in ca to pm me when they have these troubles and i can promise you...I dont need to lie!

If you say anything over the limit you have just admitted speeding to a very reliable witness. And don't think that if a few months go by he will forget what you said. It's all written down in his notes. Why make it an instant win for the officer.
