What I find amusing is that the guy had the balls to deliver the car like that after he smashed it. Huh! Anyway, I am glad you had a good settlement. Better luck next time.

I'm not an insurance expert but, here's a few nuggets for ya. Take them for what they're worth.




Last, be careful with a legal threat. Many insurance reps will "shut down" once legal action is threatened. If you threaten legal action be prepared to go the whole mile and they'll certainly have deeper pockets. Be careful here.

(Had a car stolen once and learned a lot about the insurance process.)

Hope these tips help as they were handed down to me and I recouped thousands more than I would have.

Don't agree with this. I had a guy swerve into me on my 06 and he was on his neighbors car and took off so I followed him and the owners insurance wouldn't call me or talk to me until I threatend with my lawyer. It was handled the next day after that.

Thanks, but after 90 days of grueling bantering and stress (and a very grumpy husband/dad) to settle the last fail, my family is not ready to deal with another attempt at me purchasing one.

For those that are looking, another one just listed on ebay for $40K starting bid.

flattrack53- we thought same, so that's why we tried to buy back the salvage. However, the insurance company put the kibosh on that by declaring the car a "Structural Total Loss", which in CA means the car can never again be registered for on-road use. (Thus the reason for this post.)

That had already been done to #165, which was part of the attraction for us buying it. Unfortunately only the transport driver got to feel what it was like... :mj:

The front was torn off by the driver spinning out around an left-turn elbow in the street, running over a curb and taking out a stop sign. As the car spun a full 360 deg. he slid sideways into a fire hydrant which cause the severe damage to the driverside quarter, which was the nail in the coffin for this car. The body was so tweaked that the Ford authorized repair center said it would weaken the car too much to trust it going back on the road, especially in race use. Had to hit really hard, considering the car had a full roll cage in it...

Gary, no PM recd on this site, but got a message via ebay (if that was you). Sent a reply, but probably not the one you wanted tho... Sorry about that. The buyer came through on payment right away.

Thanks to all that bid on the R parts we had listed. We made back a decent portion of the registration fees we were forced to pay to get the R listed in our names, as per the terms of insurance settlement. All I have left is the Borla muffler section of the exhaust, if anyone wants that.

After I sold my 00R I would go by Sacramento Mustang and look at yours just to ease the pain--sorry for your loss.

Well, the unimaginable happened this weekend- Caution, reading on is not for the weak...

While attending a local carshow (Cars & Coffee-Irvine CA) I spotted what looked to be a 2000 Cobra R in attendance. I was excited to see it, so of course immediately had to ogle over this car. To my surprise (actually "SHOCK" is more accurate...), I spotted a number of unique identifying features that were identical to our former Cobra R #165 describe above as being a "structural total loss"!!! The VIN number confirmed it - R #165 is BACK on the road again with CA registration pending. A chat with the owner revealed that he was aware of the prior damage, but was undeterred from repairing the car.

I don't know how they did it, who looked the "other way", or why I was lied to about the car being a structural total loss so it could never be registered in CA for road use, but there it sat with CA registration pending... At first I was flushed with anger as the old memories about fighting with the insurance company came flooding back. The new owner even said HE had heard that the insurance company said what "asses" we were to deal with, and that they would do what ever they could to prevent the car from being put back in our hands.

When the "adult side" of my brain took over, I know I was mostly just sad to have lost this car and the opportunity to own an "R" car. (My family is no longer supportive of the endeavor.) But at the same time, I am happy someone gets to enjoy the many miles of life she still has left in her. -- One thing is for sure: I still am absolutely STUNNED to have happened upon this car, AGAIN...

If anyone has a Carfax or similar account, I would love to know what shows up on a report for this vehicle. :/

Yeah, I've got 50-100 photos of the damage and upgrades on this car. Why asking?
There are a few pics in the opening post that show the most visible damage.

Wow! That is incredible. Did the carrier's insurance company pay out on the damage, or did you have to deal with your own insurance company?

Yeah, the carrier's insurance paid after a grueling 5 month battle. I expected the battle, but did not expect to see someone else driving this car on the street after being told the title was being destroyed and it could no longer be registered in CA, even as a "salvage" car. If we had known it could be done, we would have bought it back in a heartbeat... The new owner said he heard how difficult we were being to deal with, and that the insurance company was doing anything they could to prevent paying us AND allowing us to get the car back. Trust me, we felt every bit of that sentiment!

What a world we live in. Forget about "rights". There is no "truthfulness" or "justice". It really just depends on who you know...
