What I find amusing is that the guy had the balls to deliver the car like that after he smashed it. Huh! Anyway, I am glad you had a good settlement. Better luck next time.
I'm not an insurance expert but, here's a few nuggets for ya. Take them for what they're worth.
Last, be careful with a legal threat. Many insurance reps will "shut down" once legal action is threatened. If you threaten legal action be prepared to go the whole mile and they'll certainly have deeper pockets. Be careful here.
(Had a car stolen once and learned a lot about the insurance process.)

That had already been done to #165, which was part of the attraction for us buying it. Unfortunately only the transport driver got to feel what it was like... :mj:
Well, the unimaginable happened this weekend- Caution, reading on is not for the weak...
While attending a local carshow (Cars & Coffee-Irvine CA) I spotted what looked to be a 2000 Cobra R in attendance. I was excited to see it, so of course immediately had to ogle over this car. To my surprise (actually "SHOCK" is more accurate...), I spotted a number of unique identifying features that were identical to our former Cobra R #165 describe above as being a "structural total loss"!!! The VIN number confirmed it - R #165 is BACK on the road again with CA registration pending. A chat with the owner revealed that he was aware of the prior damage, but was undeterred from repairing the car.
I don't know how they did it, who looked the "other way", or why I was lied to about the car being a structural total loss so it could never be registered in CA for road use, but there it sat with CA registration pending... At first I was flushed with anger as the old memories about fighting with the insurance company came flooding back. The new owner even said HE had heard that the insurance company said what "asses" we were to deal with, and that they would do what ever they could to prevent the car from being put back in our hands.
When the "adult side" of my brain took over, I know I was mostly just sad to have lost this car and the opportunity to own an "R" car. (My family is no longer supportive of the endeavor.) But at the same time, I am happy someone gets to enjoy the many miles of life she still has left in her. -- One thing is for sure: I still am absolutely STUNNED to have happened upon this car, AGAIN...
If anyone has a Carfax or similar account, I would love to know what shows up on a report for this vehicle. :/
