Oh yeah I am sure it goes to all sorts of crap which is why I said what i did in my last post.

BTW I had court this morning. I kept my license. I plead guilty to a careless driving and paid a $285. Oh and I did not bring a lawyer.

You should have hired a lawyer.

Congrats. Now you have a criminal record.

This. You just plead guilty to a misdemeanor. That will follow you to the grave and may prevent you from getting certain jobs in the future.

ouch. is that 3 or 4 points? not to mention the hit your insurance is going to take. you should have tried to get an attorney. with an attorney, money talks, you pay a higher fine, they give you a lesser charge, an attorney might have been able to get it something way lesser than that.

Not quite a traffic violation. In most states, traffic violations are civil offenses. In his state, careless driving is a criminal misdemeanor conviction.

I don't think it will be a problem. I've never had any job ask me about anything but felonies. My options were go to court and risk all the same consequences if convicted in addition to larger fines, losing my license, court costs and the thousands the lawyer was going to charge. or plea to the careless which really isn't that bad. keep my license and be done with it.

Also both careless and reckless are traffic convictions not criminal. Looking at the list of statues right now. it is MN statute 169.13.2 . considering i could have had my car impounded, gone to jail, been charged with a felony for being in excess of 100 mph and double the posted speed limit. I would say I did pretty damn good.

The statute backs up exactly what we said. I actually checked the statute before posting... You were convicted of a misdemeanor, not a traffic violation.

Subd. 2. Careless driving. Any person who operates or halts any vehicle upon any street or highway carelessly or heedlessly in disregard of the rights of others, or in a manner that endangers or is likely to endanger any property or any person, including the driver or passengers of the
vehicle, is guilty of a misdemeanor.

yes it is a misdameanor but if you look a the list of statues it breaks them down as criminal or traffic next to careless it is listed as traffic not criminal. either way it isn't a big deal.

staute 169.13.2 case type is traffic misdameanor. Same as driving a vehicle that is too heavy or a having a bumper more than 20" off the ground.

It would be worth paying a lawyer to get this expunged. I had a similiar charge when I was 19, 21 years ago. Since then the three jobs I maintained all did a criminal backround check on me and I did not have any issues.

So I finally got a hold of my lawyer the other day and said what can you do about a speeding ticket for 112 in a 70? His exact words were "holy shit, yeah I can't do anything for that in this county." I guess the county I live in is really strict on speeding.

best way to handle it without pissing them off and not admitting guilt is to say - 'officer, i really dont know' - say it sincerely - he'll prob believe that as most speeders dont know what speed they were going. doesnt get you off the hook - but it also does not admit guilt.

would not advise this - the more of a smart ass you are, the more they will **** with you.

it's a toss-up really - the attorney will cost at least $500 (if not more), but will be able to get that lowered/reduced much more than you ever will - but the thing is - will the fine and attorney be more than the fine without an attorney - that's the question. for your scenario - i think an attorney would be worth it.

This!!! When I got pulled over for 87 in a 45 the FIRST thing I did was get a lawyer. The money it saved me in insurance alone was well worth it- not to mention knocking the speed down to less than 5 over. Between the lawyer, class, and court costs I spent about $700. If I just paid the fine and increased insurance it would have been close to $3k+ over a 3 yr period. I figure I saved $2300 bucks... Simple math really.

ive always had good luck with police being as honest as possible without giving out any more info than possible.

i was pulled over for racing and 95 in a 55 many yrs ago. trooper asked if i knew my speed i said not exactly. he reduced it to 80. i went to court and got it reduced to 69. he never showed.

i was pulled over a few yrs ago for speeding in the town i live in coming home from work. i pulled over immediately into a repair shop parking lot where it was safe. i had my paperwork ready and said i was stupid for what i did. after checking my record which is clean i got a lecture and let go.

dont play stupid or claim you didnt do anything if you did. thats not going to work.


an officer once told me to fight all tickets. most will get reduced if youre not an idiot.

Wait, so the LEO did not show to court and you still got fined? To my knowledge, every time a LEO doesn't show for a court appearance the case is thrown out and you are free to go. Only happened to me once, however, friends have been let go numerous times due to LEO's not showing to court.

I agree with the second statement oranges said.

OP, as long as you are not getting a job which involves driving at all, I would just be up front with them about it if they mention a background check prior to employment. Also, I would seek out a lawyer to try and have it expunged.

You made out better than the guy I took in Sunday for 102. 3 charges including felony child endangerment. Where I work, once you start breaking 80 you are hiring an attorney to minimize the length of your jail term. How much traffic was out? Time of day? Important things you want to have a record of. Any chance you were suffering from a nicked artery and you were rushing yourself to the hospital?

LAWYER UP! It is well worth it in most cases, they may not be able to make it go away completely, but it will be better then anything you could dream of doing.

My two examples are:

I hold a Commercial License out of Texas

State of Missouri: personal vehicle 95 in a 55, was requried to be in court, I hired a lawyer in the county in question paid him 300.00(over the phone) and when all said and done he got it knocked down to "failure to register" 250.00 or so fine to the court and I sat at home back in Texas. I'LL TAKE IT!

State of Texas: personal vehicle 84 in a 45, hired local lawyer in city in question paid him 600.00, didn't hear from him or the court for 8 months, notice came from the court and his firm for a court date. I showed, he called me outside the courtroom and said GO HOME.....DISMISSED. I was dumbfounded, no fine; nothing.

These were just my personal outcomes, and may not be the norm. As mentioned above I have a CDL which makes it even a bigger stretch to get out of these "excessive" citations.

It was probably 5:30 pm no other cars on the road but I did have a passenger. The officer didn't ask for his lisence or anything hopefully he forgot to put I had a passenger in his report lol. The lawyer said he is almost certain if it would have been nite or cars on the road I would have been arrested and probably slapped with a careless driving ticket at the least. He said the only reason I didn't get arrested was because I was cooperating or the LEO didn't wanna f with all the added paperwork lol.

I'm not. I'll take responsibility for what iv done. But I'm gunna do anything possible to get the ticket dropped or the speed reduced.
you are not taking responsibility for your actions when you try to get it reduced, especially to the extent you are talking about. it is called responsibility advoidance.

get your shit in order now. give your boss fair warning, be sure you have enough vacation time to cover the time you are in jail.
